A diabetic restaurant chef’s foot was exposed to raw sewage that emanated from kitchen floor drains resulting in a bone infection and a condition known as Charcot Arthropathy, collapse of mid arch and fractures. Multiple surgeries were performed to eradicate the infection which permanently disfigured his foot.  As a result, he was unable to return to work. The defendants defended the case claiming the plaintiff’s preexisting diabetes was the cause of his foot collapse and need for surgeries. He was awarded Social Security Disability benefits. Plaintiff alleged the building's owner and management company negligently maintained the sewer pipes resulting in a sewer backup. The defendants defended the case claiming the plaintiff’s preexisting diabetes was the cause of his foot collapse and need for surgeries. Suit was filed and the case settled after the plaintiff’s deposition. $375,000 of the settlement was allocated to the plaintiff's wife for loss of consortium. The injured worker's workers' compensation case settled for $320,000.
